New Delhi. The process of appointment of judges in the High Court is through a well-established procedure where the High Court takes into account the seniority of the collegium, the qualifications of the judges and all the information obtained about them by the government. The Supreme Court made the remarks while trying to block the promotion of a judge and imposing a fine of Rs 5 lakh on a lawyer for misusing court proceedings.
A bench of Justice SK Kaul and Justice MM Sundaresh observed this while dismissing the petition filed by a lawyer. At his request, the lawyer sought to consider his protest against the proposal to appoint High Court Registrar General A Venkateswara Reddy as a judge of the Telangana High Court and issued an order.
In fact, the three-member Supreme Court collegium meeting on August 1 approved a proposal to promote six judicial officers, including Reddy, as judges of the Telangana High Court. The country’s apex court was hearing an application by Advocate B Shailesh Saxena seeking directions from the Center, Telangana and the Registrar (Vigilance and Administration) of the Telangana and Telangana High Courts to consider the protests filed by the advocate.
The petitioner has made several allegations against Venkateswara Reddy, the Registrar General of the High Court, and said that he should not be promoted as a judge. A bench of Justice SK Kaul and Justice MM Sundaresh said, “We are surprised at the impunity of the petitioner as he is now filing the present petition under Article 32 of the Constitution of India.”
The apex court bench said, “We think that proper recovery of expenses seems to be the only solution. We thus dismiss the writ petition and direct the Supreme Court’s Advocates on Record Welfare Fund to deposit Rs 5 lakh within four weeks. We also consider it appropriate that , The Bar Council of Telangana may inquire into the conduct of the applicant as a member and a copy of the order may be sent to the Bar Council of Telangana for that purpose.
